DETROIT, MI – This ruling is historic for gay men and women in Michigan. They are now legally allowed to get married in the State of Michigan based on the ruling by U.S. District Judge Bernard Friedman.
This now also opens the door for same-sex couples to adopt. Judge Friedman said the constitutional amendment, passed by the voters in 2004, known as the Michigan Marriage Act, was unconstitutional because it denied gays and lesbians equal protection under the law.
Washtenaw, Oakland and Muskegon counties will start issuing marriage licenses Saturday.
Macomb County Clerk Carmella Sabaugh said it will be “business as usual” at her office on Monday, assuming the appeals court doesn’t issue a stay. Couples can apply online over the weekend, but they would have to come into the clerk’s office in person Monday to get the licenses.
Washtenaw County will be accepting marriage license applications on Saturday to help same-sex couples tie the knot.
The vital records office at 200 North Main Street in Ann Arbor will be open tomorrow from 9 a.m. until 1 p.m.
“As far as we’re concerned, we’re abiding by the federal court appellates,” Kestenbaum said. “We’re not typically open, but basically the Board of Commissioners strongly urged me to be open tomorrow.”

Michigan Attorney General Bill Schuette filed an emergency request for stay of Friedman’s ruling. Schuette filed the request with the U.S. 6th Circuit Court of Appeals in Cincinnati at 5:17 p.m., about 10 minutes after Friedman’s ruling showed up on the federal docket in Detroit. The Appeals Court acknowledged the receipt of the motion at 5:45 p.m.

Congressman Dan Kildee (MI-05) issued the following statement today after U.S. District Judge Bernard Friedman ruled Michigan’s ban on gay marriage unconstitutional:
“Equality and love prevailed over injustice and hate today. I am overjoyed that Judge Friedman found Michigan’s discriminatory ban on gay marriage unconstitutional and appropriately tossed it aside. With today’s historic ruling, Michigan joins a growing number of other states in recognizing that everyone should be treated equally under the law, including the right to marry whom you love.
“Equality for lesbian, gay, bisexual and transgender (LGBT) Americans is the major civil rights issue of our time. I am proud to stand on the right side of history with the overwhelming majority of Michiganders who support marriage equality.
“It’s my sincere hope that Gov. Rick Snyder and Attorney General Bill Schuette will respect the ruling of the federal court today and stop wasting taxpayer dollars in defending such a blatant, discriminatory ban.”
