Barry County Felonious Assault turns into Death Investigation

DELTON, MI – On October 3rd, 2014 Barry County Sheriff Deputies responded to 7149 Pike Rd, Delton, MI on a report of a neighbor dispute.

Deputies from the Barry County Sheriff’s Office, assisted by Michigan State Police, Barry Twp Police, Prairieville Twp Police, Delton Emergency Services and Mercy Ambulance Service investigated an argument that escalated into a Felonious Assault in which the victim, 43-year-old, Brian Sutherland, was struck in the head with a shovel.

Neighbors say it started as a simple conversation about a dirt roadway in front of their homes.  The situation got out of hand during the conversation about small trenches dug by a nearby homeowner.

The dispute escalated to the point that the suspect39-year-old, Mike Curtis,  picked up a shovel and struck the victim over the head at least once. It is a possibility that golf club may also have been involved.

Reports are that Mike Curtis is the ex-brother in-law to Brian Sutherland.

Curtis, was placed under arrest at the scene, and lodged at the Barry County Jail on a $200,000 bond.  He eventually was released on bond and was never formally charged.

The victim was transported to Bronson Hospital by Air Care.  Brian Sutherland, died on November 5th, 2014 as a result of injuries sustained. The incident remains under investigation.

Further charges are expected to be filed.

Brian passed away November 5, 2014. Brian was born July 19, 1971, in Kalamazoo, the son of Dan and Paula (Nichols) Sutherland.

Brian will be remembered as a giving man, often repairing vehicles or other items for family and friends and a hardworking man who was very creative.

He enjoyed going to garage sales, playing old time video games and was very fond of his pets. Brian’s favorite holiday, was Halloween, when he would always have a massive party.

On September 18, 2006, Brian married Janice Rugg, who survives. Brian is also survived by his daughter: Megan Sutherland: his mother and step father: Paula and John Lepley, his father and step mother: Dan and Beverly Sutherland, a brother: Eric (Cassi) Sutherland, sisters: Laura Curtis, and Heather Sutherland, a step brother: Brandon (Claire) Lepley, a step sister: Fallon (Brent) Awe, grandparents: Warren and Lou Sutherland and June and Louis Hall, his mother in law: Phyllis Rugg, and several aunts, uncles, cousins, nephews, nieces, brothers and sisters in law. Brian was preceded in death by his grandmother: Joanne Sutherland, his grandfather: Paul Nichols and an uncle: Dan Nichols.

Brian’s family will receive friends, Monday, 5:00 to 8:00 PM at the Williams-Gores Funeral Home, Delton, MI where his memorial service will be conducted, Tuesday, November 11, 2014, 11:00 AM, Pastor Jeff Worden, officiating. Private burial will take place.
