ALPENA, MI – Two men, formerly from Alpena, a father and son, have been arraigned on multiple counts of Criminal Sexual Conduct involving children dating back to the 1990’s.
James William Freese Sr., 60-years-old, and James William Freese, Jr., 41-years-old were taken into custody in Mackinac County in 2013. The two men were brought back to Alpena County to face those charges.
James Freese, Sr. is facing five counts of criminal sexual conduct (CSC) in the first degree. It is alleged that in one of those counts he had sex with a girl under 13 years of age in 1990.
James Freese, Jr. is charged with 12 counts of criminal sexual conduct assault on teenagers, including at least one under the age of 13, spanning more than a decade. His charges involve at least 6 individuals.
According to the complaint he allegedly committed criminal sexual conduct on victims under the age of 13 in 1992, 2010 and 2012. Other assaults involved older children, and the prosecutor’s office is alleging force was used. The alleged assaults took place in Maple Ridge and Alpena townships from 1990 to 2012.
In both cases some of the victims were relatives.
Andrew Joseph Freese, 31-years-old, had been charged with two counts of CSC – 1st degree. His two charges had stemmed from allegations that in September 2002 he committed sexual assault with intent to commit sexual penetration and criminal sexual assault on a child under 13. Those charges have been dropped against him due to an uncooperative witness.
Attorneys for both defendants asked for more time for discovery and were given until April 6th, 2015 to file pre-trial motions. They have both been bound over to Circuit Court.
Both have pleaded not guilty. If convicted, they could face life in prison.
