Marlon David Robertson, 23-years-old, was convicted of criminal sexual conduct third degree after entering his neighbor’s home on July 3rd, 2017 and forcing her to have sex.

According to testimony at trial, both Marlon Robertson and the victim had attended a neighborhood Fourth of July party earlier in the evening. The victim returned to her apartment and around 5:00AM she finds Robertson standing in her room with a gun in his hand. He then sexually assaulted her at gunpoint, according to testimony.

Marlon Robertson has a prior conviction from 2012 for unarmed robbery when he was 15. He currently has two cases pending in Circuit Court for drug-related charges, fleeing and eluding police, and resisting and obstructing police.

“This was a challenging case for a number of reasons,” said Genesee County Prosecutor David Leyton after the verdict was returned. “In the end, the jury convicted the defendant of a violent sexual assault and he will be sentenced accordingly,” he said.

Based on Michigan’s habitual offender statute, Marlon Robertson faces up to 22.5 years in prison when he is sentenced on October 28th.
