BENTON HARBOR, MI – Kraig Smith, 48-years-old, of Benton Harbor, was arraigned in the 5th District Court in Berrien County on Wednesday April 14th, 2021 on four counts of First Degree Criminal Sexual Conduct. Each count is a felony punishable by up to life in prison.
In May 2020, the Michigan Department of Attorney General initiated an investigation after Erin Smith reported her husband, Kraig Smith, had sexually assaulted her hundreds of times over the course of their 13-year marriage.
“Coercive assault can take place in any setting; even in a marriage,” said Michigan Attorney General Dana Nessel . “An individual should feel safe in their home with their partner. I hope this case encourages public awareness of coercive assault and makes clear that assault by a domestic partner is a crime that will be prosecuted.”
Erin Smith reports the coercive assaults first began following her marriage to Kraig Smith in December 2006. Erin Smith reported that Kraig Smith subjected her to repeated unwanted sexual activity throughout their marriage. Erin Smith alleges she was repeatedly verbally and emotionally abused by Kraig Smith, and that he threatened her and their children on multiple occasions.
A preliminary examination has been scheduled for April 27th, 2021 at 9:30 a.m. in front of Judge Gary J. Bruce. Kraig Smith has a $20,000 bond and is currently in jail.
