DETROIT, MI – Mitchell J. Dukes, 33-years-old, of Hamburg, Michigan, has been charged in connection with the fatal crash that killed Detroiters Nakia Marie Payton, 39-years-old and Daniel Damon Mixon, 49-years-old.
On July 31st, 2021, at 2:32 a.m., it is alleged that Mitchell Dukes was driving his car the wrong way on I-96 near Wyoming Ave in Detroit under the influence of alcohol when he crashed into a motor scooter. Daniel Mixon was driving the scooter and Nakia Payton was the backseat rider on the scooter.
Michigan State Police and medics were called to the scene of the crash. Ms. Payton was pronounced deceased at the scene of the crash. Mr. Mixon was transported to a local hospital where he later succumbed to his injuries. Dukes was taken into custody at the scene by MSP.
On Monday, August 2nd, 2021, a warrant request was submitted to the Wayne county Prosecutor’s Office. When it was submitted it was lacking critical evidence needed to make a charging decision and was returned to MSP for further investigation, which was recently received. On Wednesday, August 18th, 2021, Mitchell Dukes was charged with two counts of Second – Degree Murder and two Counts of Operating Under the Influence Causing Death. He was arrested today and will be arraigned Friday morning, August 19th, in 36th District Court.
“I feel like a broken record when I say that crimes involving speeding cars, wrong way drivers, drag racing, drunken driving, and an outright disregard for the rules of the road are 60% higher than they were pre pandemic,” said Wayne County Prosecutor Kym Worthy. Yet again, the lives of cherished community members have been lost forever. The charges today are no consolation for their friends and loved ones, but we will fight to ensure that justice is done.”
Mitchell Dukes was arraigned on Friday August 20th. He was given a $500,000 cash/surety bond. If he is released on bond he will have with the following conditions: he will be placed on house arrest, he cannot drive, and must have a GPS and alcohol tether.
His Probable Conference is on September 7,2021 and Preliminary Examination on September 14, 3021, both before Judge Kenyetta Stafford Jones.
